Mud Pie, LLC and its affiliates (collectively, “Mud Pie”) respect your concerns regarding your privacy. This Privacy Policy discloses the privacy practices for mudpie.com, any associated websites and official social media sites (collectively, the “Sites”).

This Privacy Policy describes the types of personal information we collect, how we might use that information and who we might share that information with.

 This Privacy Policy describes how you can contact Mud Pie to ask us to access, change, not use or delete your personal information and discuss any questions you might have regarding your personal information or our privacy practices.

INFORMATION COLLECTION, USE AND SHARING

Information We Collect and How We Collect It

You may elect to provide personal information (including your name, date of birth, street address information, zip code, phone number, other contact information, and payment information) through the Sites. In addition, you may provide such personal information by, filling out forms on Sites, including contact us forms, damage claims, credit applications, or as part of sweepstakes and drawings.

When you purchase Mud Pie products on the Sites, Mud Pie will ask for information including your name, billing and shipping addresses, email address, phone number and payment information. This information is used to process your purchase, confirm your order and deliver your purchased items. If you provide Mud Pie with permission to do so, Mud Pie might also use your contact information to communicate with you about products, services and promotions. If you make a purchase through this website, our third-party payment processor service providers may also collect billing information, such as your first and last name, email address, phone number, credit card or debit card number, and billing and shipping addresses. If you make a purchase over the phone, we will collect this personal information and share it with our third-party payment processor service providers.

My Account

You may choose to register a customer account on the Sites. In order to register a customer account, we ask for information such as your name, email address, phone number, zip code and birth date.

 

 

Mud Pie Wholesale Accounts

If you operate a retail business, you may use the Sites to apply to create a wholesale account. Please note that approval or disapproval of any wholesale account shall be in Mud Pie’s sole discretion. As part of the wholesale account application, we ask for information such as the company name, “doing business as” designation, business type, full name of the applicant, email address of the applicant, Tax ID/Employer Identification Number for your business, url or website address for your business, and number or years in business.  In addition, we ask for your billing and shipping information, including billing and shipping contact name, phone number, billing and shipping address and zip code.

From Social Media Sites

We may collect information from you if you use social media applications or websites in connection with this website, or that allow you to share information with Mud Pie. For instance, if you use social media platforms or networks in connection with our website (i.e., to log into an account, purchase products, or to share purchases, products, and other content with your friends and followers on social media), we may collect the information that you share with us, or that those social media platforms or networks share with us. We may collect aggregate, non-user specific data from social media platforms such as site referrals from Pinterest, Instagram. Information Collected Through Automation

We obtain certain information by automated means when you visit our website, such as through cookies, web beacons, and web server logs. The information we collect in this manner includes the IP address of the device you use to connect to the internet, unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our site, dates and times of website visits, and the pages accessed. By collecting this information, we learn how to best tailor our website to our visitors and understand what products and services you might prefer. We, along with others (such as our service providers) may collect personal information about our visitors’ online activities over time and across third-party websites.

We also retain service providers who use web beacons to assess the effectiveness of our email communications and learn what pages our visitors viewed. Information Mud Pie May Share

We do not sell your personal information to third parties.

We may disclose your personal information to a third party for a business purpose, however, we do not disclose your personal information, except as described in this Privacy Policy. We may share the personal information you provide to us with our employees, representatives, officers, agents, affiliates, third party sales divisions, licensees, and joint venture partners for the purposes described above, in order to operate our business, this website and any services provided in a manner consistent with this Privacy Policy. We also may share the information with our service providers who perform services and/or support functions on our behalf based on our instructions. These service providers are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.

We also may disclose information about you (i) if we are required to do so by law or legal process (such as a court order), (ii) in response to a request by law enforcement authorities, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity, or (iv) exercise or defend legal claims. We also reserve the right to disclose or transfer personal information we have about you in the event we sell, pledge or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation), or as part of a due diligence process in association with such a sale, pledge or transfer. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information.

EXERCISING DATA ACCESS AND DELETION RIGHTS

If you are a California resident and would like to exercise the access and deletion rights described in the CCPA, please submit a verifiable consumer request to us by either:

Only you or a person legally registered with an applicable, controlling governmental authority that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We will respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt.  The response we provide will also explain the reasons we cannot comply with a request, if applicable. 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

NON-DISCRIMINTAION

If you are a California resident, we will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

CHILDREN’S PRIVACY

Mud Pie’s Sites are not directed at children under the age of 13. If we obtain actual knowledge that any information we collect has been provided by a child under the age of 13, we will promptly take steps to delete that information

LINKS TO OTHER WEBSITES

Mud Pie’s website(s) and official social media sites may contain links to third-party websites, which may have privacy policies that differ from our own. These links are provided for the convenience of visitors and we are not responsible for the content or privacy practices of such websites.

CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the revised policy to this website and provide a notice on our website homepage.
